1. Scope of Services

We specialize in the design, development, and deployment of scalable websites. The specific scope, features, and deliverables for your project will be outlined in a separate project proposal or statement of work.

1.2 Future Services

We are actively developing proprietary Customer Relationship Management (CRM) systems, Content Management Systems (CMS), and various AI-powered tools. These tools are not yet available and are not included in any current Service package. Once launched, they will be governed by their own specific terms of use. Upon their deployment, clients will be granted access to the data relevant to their website(s) through these tools.

2. Fees and Payment

2.1 Base Package Fee

The full payment for the selected base package starting price is due upfront before design work begins. Upon your written approval of the provided mock design, development will commence.

2.2 Additional Features

Any features, pages, designs, or functionality requested after the initial mock design approval will be considered an "Additional Feature." All Additional Features, design modifications, and functionality changes will be quoted separately and billed on a per-feature basis. Payment for Additional Features is due before work on them begins.

2.3 Monthly/Annual Service Fee

To launch, deploy, and maintain your website live on the internet, you must subscribe to a monthly or annual service plan. This fee covers hosting, cloud server access, basic maintenance, and technical support. The first service fee payment is required before your website goes live. Failure to maintain timely payment of this fee may result in the suspension or termination of your live website. We will only allow a one month grace period after missing or late payment with a late fee billed on the next billing cycle.

3. Cancellation and Refunds

Should you choose to cancel the project before the final website is launched, you will be refunded 50% of the base package price. The remaining 50% is a non-refundable fee covering the work completed, including consultation, mock design creation, and administrative costs. Additional features will not be refunded. If you should cancel after the website launch you will not be refunded. Upon cancellation, you have the option to receive a digital printout of the approved mock design. No source code, development files, or other digital assets will be provided.

4. Data Handling and Privacy

4.1 Data Storage

All client and website-related data is stored securely in a PostgreSQL database management system (DBMS).

4.2 Data Privacy Commitment

We will not sell, lease, or otherwise distribute your data to third parties for marketing or any other purpose not directly related to providing the Services.

4.3 Change of Control

In the event that Eazy Way Productions is subject to a merger, acquisition, or sale of all or substantially all of its assets, your data will be considered a company asset and may be transferred to the new entity. The management of your data will then be governed by the terms and conditions and privacy policy of the successor entity.

5. Third-Party Services

We may integrate third-party tools and services (e.g., payment gateways, analytics tools, APIs) to provide full functionality for your website. Your use of these integrated services is subject to the terms & conditions and privacy policies of those third-party providers. It is your responsibility to review and comply with them. We are not liable for any issues, data breaches, or disputes arising from your use of third-party services.

6. Limitation of Liability

To the maximum extent permitted by law, Eazy Way Productions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law principles.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. You are advised to review these Terms periodically for any changes.
